They do not apply to separately operated businesses, outside providers, partner organizations, third party websites, independent clinical providers, or independent platforms unless specifically stated in writing.

1. Acceptance of Terms

By accessing the SHCTA website, submitting a form, requesting information, applying for enrollment, participating in a program, making a payment, donating, sponsoring, volunteering, attending an event, using a digital platform connected to SHCTA, or otherwise interacting with SHCTA, you agree to comply with these Terms and any additional written policies, program agreements, enrollment documents, handbooks, waivers, consent forms, payment terms, refund policies, donor terms, volunteer agreements, or partner requirements that apply to the specific activity.

If you do not agree with these Terms, you should not use the website, submit forms, access SHCTA systems, or participate in SHCTA programs unless a separate written agreement applies.

2. About SHCTA

Shell Hebert Career & Technical Academy, also referred to as SHCTA, we, us, or our, is a nonprofit educational organization providing academic pathways, career and technical education, workforce training, student support services, summer and enrichment programming, volunteer opportunities, and community based programs.

SHCTA serves students, parents, guardians, caregivers, adult learners, donors, sponsors, volunteers, workforce partners, educational partners, community partners, and website visitors.

3. Enrollment Policies

All enrollment forms, applications, required documents, consent forms, payment documents, emergency contact forms, student records, and program specific documents must be completed accurately and submitted by the stated deadlines. Incomplete, inaccurate, late, outdated, or misleading submissions may result in delayed processing, denial of admission, paused services, removal from a program, loss of eligibility, or other appropriate action.

Students, parents, guardians, adult learners, and responsible parties are responsible for providing updated records as needed. This may include academic records, transcripts, identification, emergency contact information, allergy information, medication or health related instructions, authorized pickup details, accommodation requests, support information, billing information, and other documents required for enrollment, participation, safety, compliance, or funding.

Program participation may depend on age, grade level, academic readiness, available seats, required documentation, payment status, parent or guardian consent, safety considerations, prerequisites, funding requirements, partner requirements, background checks, or other eligibility criteria.

SHCTA reserves the right to deny, delay, pause, suspend, or end participation when necessary for safety, compliance, unpaid balances, incomplete records, conduct concerns, program fit, lack of required consent, operational needs, or other legitimate institutional reasons.

4. Student Conduct

Students, adult learners, program participants, parents, guardians, volunteers, visitors, staff, contractors, and partners are expected to behave respectfully, responsibly, honestly, and safely at all times.

Disruptive behavior, harassment, bullying, intimidation, threats, discrimination, retaliation, violence, unsafe conduct, weapons, illegal substances, damage to property, or conduct that interferes with instruction, programming, field trips, events, online learning, campus operations, or the rights of others will not be tolerated.

Violations may result in redirection, parent or guardian contact, written warning, removal from an activity, suspension, dismissal, loss of program eligibility, loss of digital access, referral to appropriate authorities, legal action, or other disciplinary action deemed appropriate by SHCTA.

5. Academic Integrity

SHCTA maintains a zero tolerance policy for cheating, plagiarism, falsifying academic work, falsifying attendance, falsifying records, misrepresenting identity, submitting work completed by another person, unauthorized use of artificial intelligence tools, copying assignments, test misconduct, or any other academic dishonesty.

Students and adult learners are responsible for completing their own work, properly crediting sources, following testing rules, maintaining honesty in academic and training records, and submitting truthful information related to attendance, assignments, assessments, certifications, internships, or program completion.

Violations of academic integrity may result in required resubmission, loss of credit, failing grade, suspension, expulsion, dismissal, loss of program eligibility, loss of certification eligibility, removal from a course, notification to parents or guardians when applicable, notification to funding or partner entities when required, and legal or administrative consequences when appropriate.

SHCTA may use reasonable methods to review academic integrity concerns, including instructor review, platform records, assignment history, testing records, attendance records, interviews, documentation, and other available information.

6. Student Rights and Responsibilities

Students at Shell Hebert Career & Technical Academy have the right to a respectful, inclusive, and supportive educational environment. SHCTA is committed to providing access to learning opportunities without unlawful discrimination based on race, color, national origin, sex, age, disability, religion, background, or any other status protected by applicable law.

Students also have responsibilities. Students are expected to:

  • Actively participate in their academic progress
  • Attend scheduled classes, activities, and required program components
  • Communicate honestly and respectfully
  • Follow school rules, program expectations, and staff instructions
  • Abide by all institutional policies, safety requirements, and conduct expectations
  • Use technology, course materials, and facilities responsibly
  • Respect the rights, property, privacy, and safety of others

Violations of student rights or responsibilities may be addressed through SHCTA’s disciplinary, grievance, safety, academic, or administrative process.

7. Parents, Guardians, and Authorized Adults

Parents, guardians, caregivers, and authorized adults play an important role in student success and safety. They are responsible for providing accurate contact information, emergency information, authorized pickup details, required consents, custody information when applicable, and timely communication with SHCTA.

Parents and guardians are expected to communicate respectfully with SHCTA staff, instructors, volunteers, students, and other families. Harassment, threats, abusive communication, repeated disruption, unsafe conduct, or refusal to follow safety procedures may result in limited campus access, removal from events, required communication boundaries, or other appropriate action.

For adult learners and eligible students, SHCTA may require consent before sharing certain records or information with parents, guardians, sponsors, employers, or other third parties unless disclosure is permitted or required by law, safety needs, program rules, or written authorization.

8. Student Support and Accommodations

SHCTA is committed to providing a respectful, inclusive, and supportive learning environment. Students or families who need accommodations, learning support, behavior support, executive functioning support, accessibility assistance, dietary consideration, health related consideration, or other support should notify SHCTA as early as possible.

SHCTA will review support requests based on information provided, available resources, safety needs, program requirements, staffing, documentation, and applicable law. Some supports may require documentation, parent or guardian consent, outside provider input, individualized planning, or additional review.

SHCTA is an educational organization and is not a medical clinic. Outside therapists, clinicians, healthcare providers, behavioral providers, speech providers, occupational therapy providers, physical therapy providers, counselors, or other independent providers may have separate consent forms, privacy notices, scheduling rules, billing practices, and legal obligations.

9. Health, Safety, and Emergency Situations

SHCTA may take reasonable steps to protect the health, safety, and well being of students, adult learners, staff, volunteers, visitors, and the community. This may include emergency contact, parent or guardian notification, emergency medical services, incident documentation, temporary removal from an activity, health related precautions, safety planning, mandatory reporting when required, or referral to appropriate authorities.

Parents, guardians, adult learners, and participants are responsible for notifying SHCTA of allergies, medical needs, medication concerns, emergency care instructions, authorized pickup changes, custody limitations, safety concerns, behavior concerns, or other information that may affect safe participation.

SHCTA reserves the right to postpone, cancel, modify, relocate, suspend, or restrict programs, activities, field trips, events, services, or access due to illness, staffing, weather, building conditions, transportation concerns, safety issues, public health concerns, vendor issues, student conduct, emergency circumstances, or other operational needs.

10. Website Usage and Digital Access

Users must respect all content, intellectual property, digital platforms, student records, private information, technology systems, and branding associated with SHCTA. Unauthorized duplication, distribution, access, scraping, copying, sharing, or misuse of website materials, course materials, digital systems, or private data is strictly prohibited.

By accessing SHCTA’s website, online learning platforms, student portals, forms, payment links, email systems, file links, or digital services, users agree to:

  • Use all content and systems solely for lawful, educational, enrollment, donor, volunteer, or program related purposes
  • Not attempt to gain unauthorized access to systems, accounts, private student data, staff data, donor data, records, or files
  • Not share passwords, misuse login credentials, or impersonate another person
  • Not misrepresent identity, enrollment status, academic work, volunteer status, payment status, or authorization
  • Not upload harmful code, spam, malware, deceptive content, or disruptive content
  • Not interfere with website security, online instruction, forms, payments, systems, or platform operations
  • Not use SHCTA systems to harass, threaten, discriminate, exploit, or harm others

Violations may result in loss of access, academic consequences, disciplinary action, administrative action, financial responsibility, legal recourse, referral to appropriate authorities, or other appropriate remedies.

11. Intellectual Property and Content Usage

All instructional materials, curriculum content, lesson plans, handouts, presentations, forms, policies, graphics, videos, photos, website content, software content, branding, logos, designs, program descriptions, and other materials created by or for SHCTA are the intellectual property of Shell Hebert Career & Technical Academy or are used with permission.

These materials are provided solely for authorized educational, enrollment, training, donor, volunteer, or program purposes. Reproduction, sharing, resale, copying, redistribution, uploading, public posting, commercial use, competing use, or modification without written permission is strictly prohibited.

Students and families may use SHCTA materials for their own participation in the program for which the materials were provided. That permission does not allow public sharing, resale, reposting, redistribution, use in another school or program, or use for commercial purposes.

Violations of intellectual property rights may result in disciplinary action, removal from a program, loss of access, demand to remove or return materials, financial liability, and legal recourse.

12. Privacy and Data Protection

SHCTA values privacy and takes student, family, donor, volunteer, staff, and partner information seriously. Personal data collected through enrollment, program applications, financial aid related forms, donor forms, volunteer forms, online learning platforms, payment platforms, website forms, and other SHCTA related systems is handled in accordance with SHCTA’s Privacy Policy, internal privacy practices, and applicable laws.

SHCTA is committed to safeguarding student data and complying with FERPA, COPPA, HIPAA if applicable, Texas privacy laws, and other applicable data protection laws to the extent those laws apply to SHCTA’s specific programs, records, funding sources, provider relationships, and operations.

SHCTA does not sell personal information. SHCTA does not knowingly sell personal information of children.

Student records, support information, disability related information, health related information, donor information, volunteer information, and payment information may be subject to additional privacy, confidentiality, retention, or reporting requirements depending on the context.

13. Data Retention Policy

SHCTA retains student records, program records, personal information, donor information, volunteer information, financial records, and operational records in accordance with applicable state and federal law, program requirements, funding requirements, tax requirements, audit requirements, and internal recordkeeping practices.

  • Academic and enrollment records are maintained for a minimum of 5 years unless a longer period is required by law, agreement, funding source, accreditor, regulator, partner, or institutional need
  • Financial aid related documents, scholarship documents, grant documents, sponsorship documents, and payment records may be retained for at least 3 years after the last award year, transaction year, reporting year, or applicable audit period, unless a longer period is required
  • Personally identifiable information is stored securely and deleted, archived, or limited when no longer required for legal, educational, financial, safety, compliance, audit, or operational purposes
  • Students, parents, guardians, eligible students, and adult learners may request access to applicable records by submitting a formal request to SHCTA

Some records may be retained longer when necessary for transcripts, program completion verification, legal claims, audits, tax records, safety records, donor records, investigation records, or institutional protection.

14. Tuition, Fees, Payments, and Refunds

Tuition, fees, deposits, payment plans, discounts, scholarships, sponsorships, third party payments, and refund rules may vary by program. The specific payment terms for a student, adult learner, or participant may be provided in enrollment documents, invoices, payment plans, program agreements, written offers, refund policies, or other official SHCTA communications.

Families, students, adult learners, and responsible parties are expected to make payments by the stated deadlines. Late, declined, incomplete, disputed, or missed payments may result in delayed enrollment, paused services, loss of access, removal from a program, collection activity, or other action allowed by the applicable agreement and law.

Refunds are not guaranteed unless required by law or stated in the applicable written refund policy, enrollment agreement, program agreement, payment terms, or official SHCTA communication. Fees paid to third party vendors, testing providers, payment processors, curriculum providers, background check providers, or partner platforms may be subject to separate rules and may be non refundable.

SHCTA reserves the right to correct pricing errors, invoice errors, posting errors, website errors, or clerical errors when identified.

15. Donations, Sponsorships, and Fundraising

SHCTA may accept donations, sponsorships, in kind contributions, grants, program support, supplies, meals, volunteer support, and other charitable or community contributions.

Donations and sponsorships are generally considered charitable support and are not payments for a guaranteed personal benefit unless a written sponsorship agreement states otherwise. SHCTA may use unrestricted gifts where they are most needed to support its mission, students, programs, operations, emergency needs, community initiatives, or organizational priorities.

Restricted gifts, sponsorship packages, grant funds, or designated donations may be subject to separate written terms, donor restrictions, funder requirements, reporting requirements, or legal obligations.

Donation refunds are not guaranteed and may be limited to duplicate transactions, processing errors, or circumstances approved by SHCTA in writing.

16. Volunteers, Interns, and Community Partners

Volunteers, interns, mentors, guest speakers, community partners, and service providers may be required to complete screening, orientation, training, background checks, confidentiality agreements, safety acknowledgments, mandatory reporting acknowledgments, or other steps before participating.

SHCTA reserves the right to approve, deny, limit, pause, remove, or end volunteer, intern, partner, service provider, or visitor participation when necessary for safety, fit, supervision, compliance, student protection, program needs, confidentiality, or organizational priorities.

Volunteers and partners must follow SHCTA policies, confidentiality expectations, student safety rules, staff direction, and applicable law. Volunteer service does not create employment, compensation, enrollment, partnership, agency rights, or continued access rights unless a separate written agreement states otherwise.

17. Third Party Platforms and Partners

SHCTA may use third party platforms, vendors, curriculum providers, learning systems, payment processors, donor platforms, background check providers, event platforms, form tools, file storage systems, communication tools, assessment providers, testing providers, referral partners, workforce partners, and educational partners.

These third parties may have their own terms, privacy policies, fees, eligibility rules, technical requirements, refund rules, accessibility practices, and support procedures. SHCTA is not responsible for third party website outages, vendor errors, platform changes, content restrictions, account issues, data practices, refund rules, technical failures, or services outside SHCTA’s direct control.

Participation in some SHCTA programs may require use of a third party platform or partner system. Refusal or inability to use a required third party system may affect participation, progress, completion, testing, certification, or access.

18. Photos, Videos, and Publicity

SHCTA may take photos or videos during programs, field trips, events, classes, camps, graduation activities, donor activities, volunteer activities, and community events.

SHCTA will seek appropriate permission before using identifiable student photos, videos, names, testimonials, success stories, or program participation details for marketing, social media, newsletters, donor reports, sponsor updates, grant reports, or public recognition.

Parents, guardians, eligible students, and adult learners may decline media permission when applicable. SHCTA may still use non identifying photos, group images without names, or images where individuals are not reasonably identifiable, unless restricted by a specific agreement or applicable law.

19. No Guarantees of Graduation, Employment, or Certification

Enrollment or participation at Shell Hebert Career & Technical Academy does not guarantee admission, continued enrollment, grade promotion, graduation, licensure, certification, test passage, internship placement, employment, wage level, scholarship approval, funding approval, donor support, college admission, or any specific outcome.

Success in any program depends on individual effort, attendance, academic performance, conduct, payment status, eligibility, documentation, outside requirements, testing rules, certification requirements, partner requirements, and fulfillment of all course and program requirements.

SHCTA provides academic support, student support, career exploration, workforce training, and community based services, but students and participants are ultimately responsible for meeting all criteria for completion, promotion, certification, licensure, employment, or other outcomes.

20. Faculty and Staff Limitation of Liability

SHCTA instructors, staff, volunteers, mentors, contractors, and representatives are committed to providing educational guidance, support, supervision, and service within the scope of their roles. However, they are not individually responsible for student outcomes, academic performance, personal decisions, employment outcomes, certification outcomes, family decisions, or a student’s failure to meet required expectations.

Faculty, staff, volunteers, mentors, contractors, and representatives are not individually liable for any perceived failure to meet student, parent, guardian, donor, sponsor, volunteer, partner, or participant expectations, to the fullest extent permitted by law.

Concerns about SHCTA programs, services, staff conduct, or institutional decisions should be submitted through the appropriate SHCTA communication or grievance process.

21. Right to Modify

Shell Hebert Career & Technical Academy reserves the right to change, update, modify, substitute, postpone, relocate, suspend, cancel, or discontinue any program, policy, tuition rate, fee, schedule, instructor, partner, platform, curriculum, activity, field trip, event, service, website content, or operational practice at any time.

Such changes may occur without prior notice when necessary for safety, compliance, staffing, funding, vendor issues, facility needs, weather, public health concerns, enrollment levels, student needs, or operational reasons.

Students, parents, guardians, adult learners, donors, sponsors, volunteers, and partners are responsible for reviewing updates communicated through official SHCTA channels, which may include website updates, email, text, phone, invoices, enrollment documents, handbooks, or direct communication.

22. Dispute Resolution and Arbitration

Any disputes, claims, or concerns related to enrollment, tuition, payments, refunds, program participation, services, digital access, website use, donations, sponsorships, volunteer participation, or other SHCTA related matters must first be brought to SHCTA in writing so the organization has an opportunity to review and respond in good faith.

If a dispute cannot be resolved through good faith communication, the dispute will be resolved through arbitration under the laws of the State of Texas, unless applicable law prohibits arbitration or a separate signed written agreement provides a different dispute resolution process.

Students, families, adult learners, donors, sponsors, volunteers, partners, and participants agree to seek resolution in good faith before pursuing arbitration or other remedies. If a separate signed agreement includes additional dispute resolution terms, that agreement may control for the specific matter covered by that agreement.

23. Questions, Concerns, and Grievances

SHCTA encourages students, parents, guardians, adult learners, volunteers, donors, sponsors, and partners to raise questions or concerns early so they can be reviewed and addressed appropriately.

Concerns may relate to enrollment, billing, refunds, academic progress, student support, conduct, safety, accessibility, discrimination, volunteer participation, donor matters, or program participation.

SHCTA may ask that concerns be submitted in writing so the organization can review the issue, gather relevant information, document the response, and follow applicable policies or agreements.

Some concerns may be governed by a separate grievance policy, enrollment agreement, student handbook, refund policy, donor agreement, partner agreement, regulatory process, or applicable law.

24. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Nothing in these Terms is intended to limit rights that cannot legally be limited, including rights related to student safety, consumer protection, required disclosures, required refunds, anti discrimination laws, disability rights, child protection, privacy rights, or other protections under applicable law.
